    Default Florida 2020 ballot amendment does not ban AR pistols, only rifles

    A future change in florida law may leave AR pistols legal, but not rifles.
    The below only applies to shoulder arms and not pistols
    Coming out of the antigun-parkland group is a ballot constitutional ballot amendment that seeks to regulate semiautomatic shotguns and rifles of any caliber that are capable of holding more than 10 rounds and so would likely include half of the .22 rimfire rifles in the state that often have tubular magazines that hold more than 10 rounds.
    This explicitly does not apply to pistols
    This subsection shall be construed in conformity with the Second Amendment to the United States Constitution as interpreted by the United States Supreme Court. 1) Definitions -a) Assault Weapons - For purposes of this subsection, any semiautomatic rifle or shotgun capable of holding more than ten (10) rounds of ammunition at once, either in a fixed or detachable magazine, or any other ammunition-feeding device. This subsection does not apply to handguns. b) Semiautomatic - For purposes of this subsection, any weapon which fires a single projectile or a number of ball shots through a rifled or smooth bore for each single function of the trigger without further manual action required. https://dos.elections.myflorida.com/...df/70490-3.pdf
    It has not yet been approved for the ballot yet.
    I have no idea if people will vote it in since 60% of the vote is needed.

    I was planning on getting AR pistols regardless. The biggie would be registering ever .22 or other semi auto firearm that holds more than 10 shots.

    They need to get signatures and a signoff by the courts on it. They have about another year to do all of that. But the wording of the bill is so flawed maybe it will not make it to the ballot.

    My guess is the authors of that bill don't know what an AR Pistol is, so they did not include it.

    You just can not change the wording and you have to start the process all over again. I do not know all of the deadlines. The final one is:
    The deadline for signatures to be certified by the Florida secretary of state in order to qualify initiated constitutional amendments for the 2020 Florida ballot was set by law to be February 1, 2020. Since state law gives the secretary of state 30 days to verify signatures, petitioners need to submit signatures on or before January 1, 2020, to guarantee that an initiative qualifies for the ballot in 2020. The signature requirement for 2020 measures is 766,200.

    While these might seem like minor details, the language was carefully chosen. BAWN hired Jon Mills, a former speaker of the Florida House of Representatives and the former dean of the University of Florida College of Law, to write the ballot proposal. Mills, who has written many amendments to the Florida Constitution, also worked extensively with gun-policy experts from Everytown, the national gun-control-advocacy organization founded by Michael Bloomberg. Mills told me that they took care to phrase the question so that it did not include what most people would consider common hunting rifles. The ballot initiative also includes specific language committing to the Second Amendment, which might bolster the amendment’s chances in the event of a legal challenge, which has been known to happen following previous gun-control initiatives.
    BAWN’s assault-weapons ban, which exempts military or law-enforcement members, would make possession of the defined weapons a third-degree felony. It would also give Floridians who already own these weapons a year to register them before their possession becomes illegal. Florida is one of only 10 states that currently prohibit a gun registry, so this would be a notable change. Because the ballot initiative is a constitutional provision, it would supersede that statute. The ban would not include handguns, which both BAWN’s ballot proposal and the Florida Constitution define as “a firearm capable of being carried and used by one hand, such as a pistol or a revolver.”

    However, a study by the RAND corporation, a public-policy think tank, found little scientific evidence to show that assault-weapons bans have effects on mass shootings, though it did find evidence suggesting that the bans cause consumers to rush to buy the weapons before they’re off the market.

    I think the governor just signed a bill that would make Constitutional Amendments even harder to pass via popular vote. Including this one.

    Grant’s amendment, among other things, would require that ballot initiatives pay petitioners by wage or hour, not by signatures gathered. It also requires that gatherers — who must be registered as an in-state petition circulator with the Secretary of State — turn in petitions to supervisors of elections within 30 days of being signed, and disclose whether out-of-state signature gatherers were hired.
    i have not heard how the signature gathering is working for this amendment. They need a little over 3/4 million signatures, but I think anti-gun groups can get that. They have until the first of the year to get them or about 7 months.
