    Default CHALLENGING THE ATTACKER TO SHOOT YOU

    There is a high profile murder case recently here in South Africa It seems to be an open and shut case of murder. What drew my interest was that the person who got shot told the person he confronted-'You don`t have the guts to shoot me.'Turned his back and walked away.

    The reason that the shooter gave for shooting was that the person had had taken his car keys before walking away. He though that he was about to be high-jacked and was only protecting his property.

    Running the incident though the S. A. Flowchart you will not get past the first question-Is this an Unlawful Attack/Act-NO-Technically speaking your car had not being high-jacked but is still in your possession minus your car keys-Lethal Force is not Justified.

    Also remembering that S. A. law values all life above property. The person clearly made the wrong decision.

    I am also left shaking my head at this new trend taking [people`s car keys in a confrontation and then taunting them that they will not be able to drive their car-Seeing it as part of some citizen`s arrest. But by doing this only managing to intensify the confrontation. And further compounding your stupidity by challenging the person to punch/shoot you.

    I believe it was Bernie Goetz. NY...illegally carried pistol vs three or four candidates for extras on the show The Vikings. Goetz...instead of heading south to Belize, turned himself in.

    Well, he was taking the subway. I'm guessing no offshore accounts and no exit strategy.

    I do recall one event where the bad guy had a pistol in his pocket...I know because I patted him down. I stepped back and gave him a chance to draw. Event told him he could reach into the pocket before we called "GO". He didn't, so I didn't shoot him. Different times back then.
